By accessing, browsing, registering an account, listing an item, or purchasing products on Kamukunji Market (“the Platform”), you acknowledge that you have read, understood, and agreed to be legally bound by this User Agreement and our Privacy Policy.
If you do not agree with any part of these terms, you must immediately refrain from accessing or using the platform.
2. User Eligibility & Accounts
- Age Requirement: You must be at least 18 years old or possess legal capacity under the laws of Kenya to enter into a binding contract.
- Account Accuracy: You agree to provide accurate, true, and complete details during registration, including your genuine mobile phone number and location.
- Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all actions originating under your account.
3. Reserved Usernames & Impersonation Policy
Protection of System Handles & Verified Brands
Kamukunji Market maintains a strictly enforced directory of reserved usernames to protect buyers from fraud and prevent impersonation.
- System, administrative, and route names (including but not limited to
admin,root,support,official,help,staff,kamukunji,billing,api,security) are strictly reserved. - You may not register handles that impersonate other persons, prominent government entities, banks, telecom operators (e.g., Safaricom, Airtel), or existing registered corporate trademarks.
- Kamukunji Market reserves the right to reclaim, rename, or permanently terminate any username that infringes upon these rules without prior liability.
4. Marketplace Facilitation Role
Kamukunji Market operates as an online venue connecting independent sellers with prospective buyers across all 47 counties of Kenya.
Notice of Independent Contracting: Kamukunji Market does not manufacture, take ownership of, or store inventory listed by third-party sellers. Any transaction, agreement, or warranty exists exclusively between the buyer and the seller.
Buyers must inspect goods personally or through verified courier representatives prior to making non-reversible payments.
5. Vendor & Seller Rules
Every merchant, vendor, and individual selling goods or services on Kamukunji Market agrees to:
- Honest Descriptions: Accurately indicate item condition (Brand New, Refurbished, or Used), clear flaws, genuine specifications, and actual high-resolution photos of the physical item.
- Transparent Pricing: Display accurate prices in Kenya Shillings (KES). Hidden fees, bait-and-switch pricing, and artificial price hikes are grounds for listing removal.
- Stock Guarantee: You must own or have legal authorization to sell the items listed in your inventory.
- Vendor ID Verification: Vendors applying for physical shop badges must submit legitimate national ID documentation and County business permits.
6. Auctions & Bidding Regulations
Kamukunji Market hosts real-time community auctions. The following binding conditions apply:
- Binding Commitment: Every submitted bid constitutes a legally binding commitment to purchase the auction lot at the bid price if your bid is the highest winning bid upon auction expiration.
- Anti-Shill Bidding: Sellers are strictly prohibited from bidding on their own listings or using secondary accounts, friends, or associates to artificially inflate bids.
- Settlement Window: Winning bidders must arrange payment and collection within 48 hours of auction completion. Failure to complete a winning bid may lead to permanent auction forfeiture and suspension of trading privileges.

8. Payments, Delivery & Safety Guidelines
Safe Transactions: We strongly urge users to meet in busy, well-lit public locations (such as malls, verified vendor shops, or courier stations) to inspect products prior to releasing M-Pesa payment.
Advance Payments: Never send advance deposits or “delivery fare” to unverified private sellers before seeing the product or verifying the vendor.
Verified Delivery Staff: When using the Kamukunji delivery rider network, check the rider’s official verification badge and tracking code within your dashboard before handing over parcels.
9. Intellectual Property & Takedown Requests
The Kamukunji Market brand, logo, graphics, design assets, and source code are the exclusive intellectual property of Kamukunji Market Limited.
If you are a copyright or trademark owner and believe a listing infringes on your rights, please submit an infringement notice to legal@kamukunji.market containing the listing URL, proof of ownership, and contact details. We investigate and resolve legitimate takedown requests promptly.
10. Limitation of Liability
Kamukunji Market is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
To the maximum extent permitted by Kenyan law, Kamukunji Market Limited, its officers, employees, and agents shall not be held liable for any indirect, incidental, punitive, or consequential damages arising out of transactions, delivery delays, disputes between buyers and sellers, or reliance on information posted by platform users.
11. Governing Law & Dispute Resolution
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the Laws of the Republic of Kenya.
In the event of any dispute arising out of or relating to these terms, the parties agree to first seek amicable resolution through good-faith negotiation. If unsettled within 30 days, the dispute shall be submitted to the competent courts of law situated in Nairobi, Kenya.
